KUALA LUMPUR: The Myanmar doctor who had examined Mohd Saiful Bukhari Azlan is standing by his medical report.

In a statutory declaration dated Aug 1, Dr Mohamed Osman Abdul Hamid @ Than Aung, reiterated that he stood by ‘his findings’.

Dr Mohamed Osman also said he had no knowledge of how his medical examination report on Mohd Saiful was circulated to the media and Internet.

“I would like to stress that I have no knowledge of the person responsible for leaking the report to any third party,” he added.

Dr Mohamed Osman said that some time in early July, he was visited by an officer from the Brickfields district police’s criminal division, ASP Rosmi Mat Derus, who interviewed him about the medical examination on Mohd Saiful.

He said ASP Rosmi recorded the statement in in his own handwriting in Bahasa Malaysia.

The following week the same officer returned with a typed statement in Bahasa Malaysia for him to read and sign.

However, he said certain facts that were not discussed in the previous meeting had been introduced in the typed statement, namely Anwar’s name.

Dr Mohamed Osman claimed Anwar’s name was never brought up during the first interview and Mohd Saiful also never confided to him about the identity of the alleged perpetrator.

About a week later I was visited by a plainclothes police officer by the name of DSP Choo from the criminal division of the Jalan Hang Tuah district police, who impressed on me that I would be charged if I refused to cooperate with the police,” he added.

Dr Mohamed Osman said he then decided to flee the country with his family as he feared for his and their safety. [more]

Malaysian Bar Council questions Ibrahim sodomy case probe

August 6th, 2008 – 2:35 pm ICT by IANS –

Kuala Lumpur, Aug 6 (IANS) Malaysia’s Bar Council has questioned the police investigation into the charges of sodomy made against former deouty prime minister Anwar Ibrahim by his former aide Saiful Bukhari Azlan. Terming reports about Azlan’s medical examination as “troubling”, Bar Council president Ambiga Sreenevasan asked whether he was interviewed by the police before it registered his complaint against Ibrahim.

“Reports that the examination, done a few hours before Saiful lodged a police report against Anwar, showed no evidence that Saiful had been sodomised by anyone has raised serious questions,” the Indian origin lawyer said Tuesday.

Sreenevasan raised the following questions:

* Was the doctor who examined Azlan interviewed by the police and was he detained for any length of time?

* Is the doctor facing any form of intimidation, and if so, from whom?

* Did the medical report by another doctor confirm or contradict the first medical report?

* If the medical report is true, showing a lack of prima facie evidence, what is the justification for the vigorous actions taken against Ibrahim as well as the public call by the authorities for his DNA sample? [more]

Sodomy mess: Set up panel to clear police

Malaysiakini, P Ramakrishnan | Jul 30, 08 4:55pm

We refer to the Malaysiakini report Anwar: It confirms plot to frame me.

The civilised world must be outraged by what is taking place in Malaysia. Justice is being trampled upon and truth is being sacrificed for political expediency without shame or remorse. And it is not fair that we have to suffer this humiliation.

Thinking Malaysians are perplexed how on earth the police went ahead to investigate Anwar Ibrahim for sodomy even though there were allegedly medical reports confirming that there was no basis for their action.

According to the medical report in the possession of Malaysiakini, Saiful was never sodomised by anyone, least of all by Anwar Ibrahim. Dr Mohamed Osman Hamid from the Hospital Pusrawi had confirmed this fact after physically examining Saiful on June 28.

Yet four hours later, Saiful made a police report at the police pondok in Hospital Kuala Lumpur that Anwar had sodomised him. At 6pm on that day, Saiful went to Hospital Kuala Lumpur for his second medical examination which, according to an unverified report by blogger Raja Petra Kamruddin also confirmed that Saiful was not sodomised. Nevertheless, he made his police report against Anwar.

The police cannot claim that they were in the dark over the existence of these reports. In any case police are required to send victims of rape or sodomy for a medical examination to confirm the allegations and collect vital medical evidence for prosecution purposes. [more]

Saiful Bukhari Azlan was allegedly checked ‘for stomach-ache complaint’

The New Straits Time Online

KUALA LUMPUR: Pusrawi Hospital’s Dr Mohamed Osman Abdul Hamid did not examine Mohd Saiful Bukhari Azlan for evidence of sodomy, a hospital official said yesterday.

Pusrawi general manager Wan Mahmud Wan Yaakob said this was because Mohd Saiful sought treatment at the hospital for stomach-ache and constipation.

Hospital director Dr Kamaruddin Ahmad, who was also at the press conference yesterday, said Mohd Saiful was first examined by a female doctor before his case was referred to Dr Mohamed Osman.

“Maybe at that time, Saiful told him that he was sodomised and Dr Mohamed Osman advised him to be checked by a specialist,” Dr Kamaruddin said.

Dr Mohamed Osman is a general practitioner at the hospital’s accident and emergency clinic and not a specialist.

The hospital called for the press conference after a medical report on Mohd Saiful was leaked to Internet news sites and blogs.

Wan Mahmud said the hospital was still investigating the authenticity of the medical report which stated that there was no sign of Mohd Saiful having been sodomised, and how it had been leaked to the public.

Hospital can be sued if report was leaked

PUTRAJAYA: Deputy Health Minister Datuk Dr Abdul Latiff Ahmad yesterday said Mohd Saiful Bukhari Azlan could sue Hospital Pusrawi if investigations showed that it was responsible for his leaked medical report.

Dr Abdul Latiff said he was told that police had started investigating the matter.

“I am sure the police will also investigate the doctor (Dr Mohamed Osman) who examined Saiful.”

Dr Abdul Latiff also confirmed that police would use the medical report issued by the Kuala Lumpur Hospital to help decide whether there was a case against Parti Keadilan Rakyat de facto leader Datuk Seri Anwar Ibrahim.

The examination on Saiful at KLH was conducted by two specialists.

“The report was made by two of my specialists, yet I have no access to it as it is confidential.” [more]

Anwar Ibrahim believes HKL report will also vindicate him

KUALA LUMPUR: Datuk Seri Anwar Ibrahim says he is “not worried at all” about the medical report from Hospital Kuala Lumpur (HKL) on Mohd Saiful Bukhari Azlan, who is accusing him of sodomy.

The former deputy prime Minister believed that another medical report, done on Mohd Saiful at the Pusrawi Hospital on June 28, just four hours prior to the examination at HKL, would also vindicate him.

He said the question though was whether the original HKL report would be torn up or amended.

“In four hours a lot of things can happen,” he charged.

The doctor who examined Mohd Saiful, 23, at Pusrawi Hospital found no evidence of sodomy as there was zero tear and scar, zero active bleeding and no ulcer or pus in his anus.

The Pusrawi’s medical report was carried by a news portal days ago.

The PKR de facto leader was speaking to reporters yesterday after giving his statement on investigations at the Federal Territory religious department.

He had filed a complaint against Mohd Saiful with the department earlier where he said Mohd Saiful had falsely accused him of fornication without producing four witnesses. [more]

Anwar foreshadows sodomy charge

MALAYSIA’S opposition figurehead Anwar Ibrahim insists he will fight a by-election later this year and form a new government despite fears he will soon be charged with sodomy.

“There are thousands of criminal cases not properly investigated. Why pursue this with zeal and in an unjust way? Is it because I will participate in a by-election,” Anwar said today.

“You want me to withdraw? No. I will continue to pursue the change. Let’s see if they want to charge me,” he said after being interviewed by Islamic sharia enforcement officials over the sodomy allegations.

The former deputy prime minister admitted that his family and friends will undergo the same suffering they experienced in 1998 if he is “victimised, arrested and jailed.”

Anwar has said the allegations of a young male aide, a repeat of charges that saw him jailed a decade ago, have been fabricated to block his plans to topple the coalition that has ruled Malaysia for half a century.

He has demanded that police stop the investigation and called the aide, 23-year-old Mohamad Saiful Bukhari Azlan, an “outright liar” who was working with others in power to frame him.

Police, however, have said they will continue sodomy investigations on Anwar despite a leaked medical report which he said had vindicated him as it showed no evidence that his accuser was sodomised. [more]
